ARTICLE 2 - SCOPE

2.1 Purpose

These General Terms and Conditions of Sale (GTCS) exclusively govern the relationship between La Boutique Brasileira and its customers in connection with the online sale of cosmetic products.

2.2 Acceptance

Every order implies full and complete acceptance of these GTCS. The buyer declares that they have read these general terms and conditions of sale and accept them without restriction or reservation.

2.3 Enforceability

These GTCS are enforceable throughout the period during which the products and services are offered online, until they are replaced by a later version.

ARTICLE 3 - PRODUCTS

3.1 Description

The products offered are hair cosmetics (shampoos, conditioners, masks, oils, etc.) that comply with current French and European regulations.

3.2 Presentation

Products are presented on the website with their essential characteristics:

  • Name
  • Composition (INCI)
  • Instructions for use
  • Precautions for use
  • Volume/weight
  • Price including taxes

3.3 Photographs

Product photographs are contractually binding. We strive to present accurate images, but slight variations may exist.

3.4 Availability

Product offers are valid as long as they are visible on the website, subject to available stock.

ARTICLE 4 - PRICES

4.1 Displayed prices

All prices are stated in euros, inclusive of all taxes, including VAT at a rate of 20%.

4.2 Price revisions

Prices may be changed at any time, but the changed prices apply only to orders placed after the change.

4.3 Applicable price

The applicable price is the one in effect when the customer confirms the order.

4.4 Promotions

Occasional promotions may be offered. Their conditions are specified when they are introduced.

ARTICLE 5 - ORDERS

5.1 Ordering process

Orders are placed online through the following process:

  1. Product selection
  2. Adding to the cart
  3. Checking the cart
  4. Entering delivery information
  5. Choosing the delivery method
  6. Selecting the payment method
  7. Confirming the order

5.2 Order confirmation

An order becomes final only after:

  • Confirmation by the customer
  • Payment confirmation
  • A confirmation email has been sent

5.3 No minimum

No minimum order value is required.

5.4 Out of stock

If a product becomes unavailable after the order has been confirmed:

  • The customer is informed immediately
  • A substitute product or refund is offered
  • Cancellation is possible free of charge

5.5 Refusal of orders

We reserve the right to refuse any order for a legitimate reason (insufficient stock, payment problem, etc.).

ARTICLE 6 - PAYMENT

ARTICLE 7 - DELIVERY

7.1 Delivery area

We deliver to metropolitan France and Corsica, the European Union (Belgium, Germany, Luxembourg, Netherlands, Spain, Italy), the United Kingdom and Switzerland.

7.2 Delivery charges

Metropolitan France and Corsica: free delivery on purchases of 79 € or more. Below 79 €, a single flat rate of 5,80 € applies (home or pickup point). An express delivery option at 14,90 € is also offered in metropolitan France.
International (regardless of the order value):
• Belgium, Germany, Luxembourg, Netherlands: 9,90 €
• Spain, Italy, United Kingdom, Switzerland: 11,90 €

7.3 Delivery times

  • Preparation: 24-48h on business days
  • Delivery in metropolitan France: 24-72h on business days
  • Delivery in Corsica: 3-5 business days
  • International delivery (EU, United Kingdom, Switzerland): 3-6 business days depending on the destination

7.6 Transfer of ownership

Ownership is transferred upon actual delivery of the products.

7.7 Transfer of risk

In accordance with article L.216-4 of the French Consumer Code, any risk of loss of or damage to the products is transferred to the customer when the customer, or a third party designated by them, takes physical possession of the products.

7.8 Parcel damaged upon delivery

The customer is invited to check the condition of the parcel upon delivery, in the presence of the delivery driver or when collecting it at a pickup point.

If the parcel shows visible damage (crushed, punctured, opened or wet box, signs of leakage), the customer must:

  • refuse the parcel, in the case of home delivery; or
  • not collect the parcel and report the damage to the shopkeeper, in the case of delivery to a pickup point;
  • then inform us within 48 h at contact@laboutiquebrasileira.com, with supporting photos if possible.

The refused or uncollected parcel is automatically returned to us by the carrier. The customer then receives, at their choice, a full refund or a new delivery at no charge.

If the customer nevertheless accepts a parcel showing visible damage, they must record precise and detailed reservations on the carrier's delivery slip and send us photos of the parcel and affected products within 48 h. If the parcel is not refused, no reservations are recorded or no report is made within this period, establishing the carrier's liability becomes very difficult and the claim may be rejected, subject to the statutory warranties referred to in article 9, which remain applicable in all circumstances.

ARTICLE 8 - RIGHT OF WITHDRAWAL

8.1 Statutory period

In accordance with article L.221-18 of the French Consumer Code, you have a period of 14 days to exercise your right of withdrawal without having to provide reasons or pay penalties.

The period begins on the day the products are received.

8.5 Exclusions

The right of withdrawal cannot be exercised for products that are:

  • Opened or used (for hygiene reasons)
  • Personalized or made to measure

ARTICLE 9 - WARRANTIES

9.1 Statutory warranty of conformity

We warrant that the products conform to their description and are free from defects.

9.2 Warranty against hidden defects

We warrant the products against any hidden defect that makes them unfit for use.

9.3 Defective products

In the event of a defective product:

  • Free priority return
  • Exchange or refund at the customer's choice
  • Return shipping costs covered

9.4 Warranty periods

  • Warranty of conformity: 2 years
  • Warranty against hidden defects: 2 years

ARTICLE 10 - LIABILITY

10.1 Limitation

Our liability is limited to the amount of the order concerned.

10.2 Exclusions

We are not responsible for:

  • Damage resulting from misuse of the products
  • Allergic reactions (prior test recommended)
  • Indirect or consequential damages

10.3 Force majeure

We are not responsible for delays or failures due to force majeure.

ARTICLE 11 - INTELLECTUAL PROPERTY

11.1 Rights reserved

All elements of the website (texts, images, logos, etc.) are protected by intellectual property rights.

11.2 Trademarks

"La Boutique Brasileira" and our logo are registered trademarks.

11.3 Prohibited use

Any reproduction or use without permission is strictly prohibited.

ARTICLE 12 - PERSONAL DATA

12.1 Processing

The processing of your personal data is governed by our Privacy Policy.

These GTCS are subject to French law.

15.2 Competent jurisdiction

In the event of a dispute, the courts of Paris shall have exclusive jurisdiction.

15.3 Language

In the event of a translation, only the French version is authoritative.

ARTICLE 16 - FINAL PROVISIONS

16.1 Entire agreement

These GTCS constitute the entire agreement between the parties.

16.2 Partial invalidity

If a clause is declared invalid, the other clauses remain applicable.

16.3 Archiving

Orders are archived on a reliable, durable medium that constitutes a faithful copy.

16.4 Evidence

Computerized records constitute evidence of communications, orders and payments.
